New York Amusement Park Accident Lawyer

Amusement park rides are fun because they make us feel the thrill of danger without actually being dangerous. The enjoyment comes from knowing that you are safe while flirting with the sensation of danger. Unfortunately, not every ride is as safe as we’d like to hope. Theme park operators are like any other business owners–some make mistakes, some cut corners, and some are simply indifferent to the risks of patrons so long as profits outweigh liabilities. If you or someone you love was injured at a waterpark, a theme park, a carnival, or other amusement park, you have the right to hold the responsible parties liable for the devastation they’ve caused.

The dedicated New York amusement park injury attorneys at Dupée & Monroe are ready to help you and your family recover compensation after an amusement park accident. Our personal injury team has decades of experience obtaining compensation for victims of all manner of accidents. We go toe-to-toe with every type of defendant, from small businesses to large corporations to government entities.  We will investigate the circumstances of your accident, collect the evidence to build a strong case, negotiate with insurance companies and defense lawyers, and fight to get you the settlement or trial award you deserve. Contact the Goshen amusement park accident attorneys at Dupée & Monroe for a free consultation after a New York theme park accident.

Strict Regulations Protect New York Amusement Park Guests

Amusement park accidents might not be as common as car accidents or construction injuries, but they do happen. In order to limit the number of preventable amusement park accidents each year, New York State and individual counties and cities across the state have strict rules and regulations governing the design and operation of all types of theme park rides. When theme park owners and operators fail to adhere to these regulations, rides fail and visitors suffer the consequences.

For example, amusement park operators must subject all rides to annual inspections, in addition to substantial testing after installation and inspection after initial use. Rides must be built to certain specifications and maintained appropriately. Regular inspections are meant to identify any potential problems that may have developed over time even with rides that were safe when initially installed. Rides must also be operated by employees of a certain age, who must be trained appropriately for operation and to identify potential risks.

Many accidents are caused by operator errors, mechanical defects, and even design defects. The New York State Department of Labor (DOL) inspects all rides at stationary parks outside of New York City at least once a year and is meant to inspect all traveling carnival rides each time they are newly set up. If an amusement park operator allows guests to ride rides that have not been properly inspected, they can and should be held liable for any injuries that result.

Common Theme Park Injuries

Not every theme park accident involves a rollercoaster cart derailing in a catastrophic fashion, although such accidents do occur. Most amusement park injuries reported by the Consumer Product Safety Commission (CPSC) involve improper restraints or insufficient padding, leading to broken bones, cuts, bruises, and other impact-based injuries. Although theme park owners require visitors to agree to liability waivers accepting the risk of some dangers inherent to the rides, when an injury results from the operators’ negligence or the designers’ failures, the park can still be held liable.

The theme park injury lawyers at Dupée & Monroe help victims recover for all manner of amusement park injuries, including the following:

  • Bone fractures and breaks
  • Concussions and other traumatic brain injuries
  • Neck, back, and spinal cord injuries, potentially leading to paralysis or coma

  • Facial injuries including broken noses, damaged eye sockets, and lost teeth
  • Severe cuts, scrapes, burns, and lacerations
