How no-fault coverage works

All New York drivers are required to carry what’s known as no-fault coverage, alternately known as Personal Injury Protection (PIP). After a car accident, injured drivers first turn to their own car insurance carriers for coverage of their expenses. All drivers are required to carry at least $50,000 in PIP coverage. In most cases, drivers must rely on this coverage rather than file a lawsuit in court against the at-fault driver. When seeking medical care, accident victims can provide their insurance information to medical providers, who will often bill the insurer directly. If the provider bills the patient instead, the accident victim must submit those bills to their insurance carrier within 45 days. If no-fault coverage is exhausted, accident victims may turn to their own health insurance coverage.

Expenses covered by no-fault benefits

No-fault benefits include more than just payment for medical expenses. Accident victims can collect lost wages under their PIP coverage. New York insurers will pay either 80% of wages lost or $2,000/month, whichever is less, if an accident victim can’t work due to their injuries. This coverage lasts for up to three years after an accident. Additionally, accident victims can collect up to $25 a day in miscellaneous accident-related costs, including the costs of transportation to and from doctor’s visits, costs related to childcare, or costs for in-home help needed due to your injuries. No-fault benefits will not provide coverage of pain and suffering damages, as a personal injury lawsuit might.
